SMS Program Terms

This page explains how LowFloatWire’s text message program works and the terms you agree to when you take part in it. When you give Low Float Wire LLC your mobile number through a signup form, an opt-in checkbox, or any other enrollment step and choose to opt in, you are giving us your prior express written consent to send you recurring automated text messages, which may include marketing, educational, and account-related messages, and you accept the terms set out below.

Texting is optional and is never required to buy anything from us. Disputes about the program are handled under the arbitration and class-action provisions in our Terms of Service, unless you opt out as that section allows. If you do not agree with any of this, please don’t opt in, and if you’re already enrolled, just reply STOP.

1. Who and what this covers

These SMS Terms of Service (the “SMS Terms”) govern every text-message program run by Low Float Wire LLC, a Wyoming limited liability company, and its affiliates, including any program tied to lowfloatwire.com and any other LowFloatWire newsletters, products, or apps (together, the “SMS Services”). In these SMS Terms, “LowFloatWire,” “we,” “us,” and “our” mean Low Float Wire LLC and its affiliates. Enrolling in any LowFloatWire text program means you consent to receive the SMS Services on these SMS Terms. These SMS Terms work alongside, and are part of, LowFloatWire’s Terms of Service and Privacy Policy; where the two conflict on something specific to texting, these SMS Terms take precedence.

2. What you’ll receive

Once enrolled, you can expect recurring texts from LowFloatWire that may include market alerts, product and feature news, educational material, account notices, and marketing. You can sign up through an online form, an opt-in box, or any other method we make available later. There’s no charge from us to enroll, though your carrier’s standard rates may apply (see Section 6).

Some of these texts are paid advertising. LowFloatWire and its affiliates are in the business of publishing and disseminating information about publicly traded companies, and some messages we send are paid promotions for which LowFloatWire or an affiliate has been, or expects to be, compensated. Any such message is a paid commercial advertisement, not investment advice or independent research, see Section 13 and our Disclaimer & Compensation Disclosure.

3. Who can sign up

The SMS Services are open only to people who live in the United States and are 18 or older. By enrolling you confirm you meet both requirements. We may ask you to verify your age or location, and we may decline or end service if these conditions aren’t met.

4. When we may text you, quiet hours waiver and Do-Not-Call consent

Message frequency varies. You agree that LowFloatWire, and anyone sending on our behalf, may text you at any hour, including before 8:00 a.m. or after 9:00 p.m. in your local time. Because you chose to give us your number and opt in, these messages carry your prior invitation and permission, which means they are not “telephone solicitations” under the Telephone Consumer Protection Act (the “TCPA”) or its rules at 47 CFR §64.1200. To the fullest extent the law allows, you waive any limit on the time of day we may message you, including any “quiet hours” restriction.

The number you give us may also appear on a federal or state Do-Not-Call list. By opting in, you consent to receive our texts even though your number is on such a list, and you waive, again, as far as the law permits, any claim that messages sent under this consent break a Do-Not-Call rule. This applies only to messages we (or someone acting for us) send under these SMS Terms.

5. Automated sending technology

If any message happens to be sent with an automatic telephone dialing system, or comparable technology described by the TCPA and the Federal Communications Commission, you agree we may use that technology to reach the number(s) you gave us. Agreeing to this is never a condition of buying anything from LowFloatWire.

6. Message and data rates

Your carrier may charge you for each text you send or receive through the SMS Services, based on your own plan. LowFloatWire charges nothing extra for the program itself, and any carrier charges are yours to pay. Message frequency varies.

7. Stopping messages

You can pull your consent and leave the program whenever you like by replying STOP to any text. We’ll send one confirmation and then stop the marketing texts to that number. You can also reach us at [email protected].

9. Keeping your number current

You confirm the number you give us is yours and that you may consent to messages at it. If you ever change, cancel, or give up that number, let us know promptly, before the change takes effect, by emailing [email protected] or replying STOP. You agree to cover and hold LowFloatWire harmless from any claim, loss, or cost (including reasonable legal fees) that results from (a) not telling us about a number change, or (b) our texting a number you supplied that was later handed to someone else, as far as the law allows.

10. Delivery and carriers

Getting a message to you depends on your carrier passing it through, which is beyond our control, and the SMS Services may be carried by the major U.S. wireless networks. Supported carriers can change at any time without notice, and not every carrier or device will work with the program. Carriers aren’t liable for late or missing messages, and neither is LowFloatWire when a message is delayed, dropped, or undelivered because of network conditions, your device, or carrier limits.

11. Keeping your device safe

Text messaging isn’t a secure channel and can be intercepted or read by others, so please look after your device. LowFloatWire isn’t responsible if a message is intercepted, misused, accessed without authorization, or never arrives.

12. Privacy

How we collect, use, and share information, your mobile number included, is described in our Privacy Policy, which also applies to your use of the SMS Services.

13. Not investment advice; paid promotional messages

Anything we send through the SMS Services is for general information and education only; it is not investment, financial, legal, or tax advice, and is not a recommendation, endorsement, or solicitation to buy, sell, or hold any security. LowFloatWire is not a registered investment adviser or broker-dealer. Your investment choices are your own, and LowFloatWire isn’t responsible for any loss or decision you make based on what we text you.

Paid promotion and conflicts of interest. Some messages are paid advertising. When LowFloatWire or an affiliate is compensated to feature a company or security, that compensation is disclosed as required by Section 17(b) of the Securities Act of 1933 on our Disclaimer & Compensation Disclosure page, incorporated here by reference. LowFloatWire generally publishes only favorable information about a promoted company.

The promoted company, the party paying for the promotion, their affiliates, and other third parties may own shares and may buy or sell them at any time, including while a promotion is running. Their selling can happen while we are sending favorable information and can cause the price to fall, potentially sharply. You should assume they may be selling into any price or volume increase a promotion helps create. Never make an investment decision based on a promotional text; read the full disclosure and risks first.

14. No warranties

The SMS Services come “as is” and “as available.” To the fullest extent the law permits, LowFloatWire disclaims every warranty, whether express or implied, including those of merchantability, fitness for a particular purpose, accuracy, reliability, security, and non-infringement, for the SMS Services and anything delivered through them.

15. Limits on our liability

As far as the law allows, LowFloatWire’s total responsibility for any claim connected to the SMS Services is capped as described in our Terms of Service, and LowFloatWire will not be liable for any indirect, incidental, special, consequential, or punitive damages tied to the SMS Services.

16. Disputes and arbitration

Any dispute about the SMS Services or these SMS Terms goes through the binding individual arbitration and class-action waiver in LowFloatWire’s Terms of Service, which we fold into these SMS Terms by reference. Arbitration is handled by the American Arbitration Association, seated in Sheridan, Wyoming, and the opt-out described in that section applies here too.

17. Governing law

Wyoming law governs these SMS Terms and the SMS Services, without regard to its conflict-of-law rules, in line with LowFloatWire’s Terms of Service.

18. Changing or ending the program

LowFloatWire may pause, change, or end the SMS Services, or your place in them, at any time, with or without reason or notice. We may also revise these SMS Terms; when we make a meaningful change we’ll post it here with a fresh effective date, and staying enrolled afterward means you accept the update. Anything in these SMS Terms that should outlast the program does so.
